Aprígio Tadeu, nos autos em referência, vem
a V. Exª o seguinte:
O requerente foi notificado para, no prazo de dez dias, apresentar defesa e juntar ao processo os elementos probatórios que entender, bem como, para utilizar a possibilidade de pagamento voluntário desde que o requeira no mesmo prazo, com direito à redução para 75% do montante que vier a ser fixado.
Na mesma notificação, foi dado ao ora requerente conhecimento da possibilidade de prestar declarações, preferencialmente, em 31/07/04, pelas 10 horas e 15 minutos.
A referida notificação, fez-se acompanhar do auto de notícia lavrado em 12/06/04, no qual, se refere, como fazendo parte integrante do mesmo os anexos 1 e 2.
Sucede, porém, que estes apêndices, maugrado constituirem um todo único com o mencionado auto de notícia, não foram juntos à notificação supra aludida. Page 120
Obviamente, que tal facto coarcta a possibilidade de defesa a que tem direito o aqui exponente.
Por ser assim, argue-se a nulidade da notificação e requer-se a V. Exª...
